TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern the services provided by Wyse Technologies (“we,” “our,” “us”) and outline your (“Customer”) rights and obligations when using our data recovery, destruction, forensics, and IT support services. By using our services, you agree to comply with and be bound by these Terms.
- Client Authorization and Representation
1.1 Authorization for Transport
You authorize Wyse Technologies’ employees, contractors, or partners to receive and transport your device to and from our facilities for processing and recovery by courier services.
1.2 Ownership of Device
By sending us your device, you represent and affirm that you are the rightful owner of the device or are an authorized corporate representative for the device sent for data recovery or related services.
- Data Recovery and Service Limitations
2.1 Data Recovery Success
While we employ state-of-the-art recovery techniques, data recovery cannot be guaranteed. In some cases, no data may be recoverable, or only partial data may be retrieved.
2.2 Device Failure
Devices may fail at any time, even while in our possession. You agree not to hold Wyse Technologies responsible for device failures occurring during or after our service process.
2.3 No Guarantee of Full Recovery
We cannot guarantee that all data can be recovered. Our success rates are high, but certain damages, such as to device platters or head assemblies, may limit recovery possibilities. If we cannot recover your data, we will inform you promptly.
- Property Retention and Disposal
3.1 Device Disposal
Any property left with Wyse Technologies for more than 60 days will be disposed of, sold, reused, or recycled at our discretion. We will not be liable for any losses, damages, or third-party claims regarding such property.
- Confidentiality and Legal Compliance
4.1 Privacy and Confidentiality
We are committed to keeping all data recovered private and confidential. Any unlawful content found (such as child pornography) will be reported to the appropriate authorities, as required by law. All other data will be kept confidential in accordance with privacy laws.
4.2 Legal Requests
If requested by law enforcement, we will provide recovered data in compliance with the law.
- Payment and Fees
5.1 Payment Due Before Data Release
Full payment is required before the release of any recovered data unless otherwise agreed in writing.
5.2 Payment Methods
We accept Visa, Mastercard, American Express, EFT/Bank transfer. Cash or cheques will not be accepted unless pre-approved by management.
5.3 Non-Refundable Fees
A non-refundable fee may apply for initial assessments or certain recovery attempts, particularly if additional services are required.
5.4 Late Payment Fees
Payment is due within 14 days of service completion. Late payments will incur a 10% fee for payments made after 14 days, 15% after 30 days, and 20% after 45 days. After 60 days, a debt collection agency may be engaged, and you will be charged an additional 25% fee by the agency.
- Data Testing and Refunds
6.1 Testing Data
Once recovery is complete, you can test your recovered files using TeamViewer software. We encourage you to verify the integrity of your data before making payment. Once payment is made or the data is delivered to you, there will be no refunds.
6.2 Cancellation After Quote Approval
If you cancel the recovery after the quote has been approved and more than 24 hours have passed, no refund will be issued. However, we will stop work and return the device to you at no additional cost. If no payment has been made, you are responsible for 50% of the quoted amount for cancellation.
- Non-Liability for Data Loss During Service
Wyse Technologies will not be held liable for any additional data loss caused by actions performed during data recovery, including but not limited to device resets, erasure, or other technical work. All efforts are made to ensure safe recovery, but human error or unexpected complications may result in data loss.
- No-Data, No-Fee Policy
8.1 Applicability
Our “No-Data, No-Fee” policy applies only to specific cases where no data can be recovered. Some circumstances may require an upfront non-refundable fee, which will be clearly discussed with you in advance.
- Special Case Recovery
9.1 Class-100 Clean Room Services
If your device requires clean room recovery due to damage such as a seized motor or head failure, we will notify you and request your permission to proceed. A non-refundable amount (starting at $500) will be charged to cover time, effort, and parts used in this complex recovery process.
9.2 Special Case Lab
If standard recovery methods fail, we may offer a special lab service as an optional upgrade. These cases may take longer and come with additional costs but are designed to provide the best chance of data retrieval from severely damaged devices.
- Forensic Services and Legal Involvement
Our data recovery services are not intended to be forensic in nature. We do not provide legal reports or chain of custody documentation. If required, we will charge $600 per hour for any involvement in legal proceedings, including preparation of documents or court appearances.
- Password, PIN, and Encryption
If your device is locked with a password, PIN, or encryption key that you cannot provide, we will still require full payment for the service, regardless of whether recovery is completed.
- Device Damage Liability
Wyse Technologies is not liable for damage to Apple or Microsoft Surface devices, including screens, caused during the device opening or repair process, unless otherwise agreed upon in writing prior to the service.
